BSR clears most legacy cases as Gateway 2 approval times fall

The Building Safety Regulator (BSR) has reported continued progress in its Gateway 2 approvals, with overall decision times falling as historical cases are resolved.

Legacy new build cases are now nearly cleared, with only two remaining, while 13 technically complex cases are now being managed under a dedicated “complex case category”.

The progress follows the BSR’s transition to a standalone regulator in January 2026, when it began reassessing complex Gateway 2 legacy cases to determine whether to reject them or allocate additional resources.

In the 12 weeks to 29 March 2026, the BSR made 284 Gateway 2 decisions covering 16,721 residential units, of which 10,165 were approved, raising the 12-week rolling approval rate to 67 per cent.

New applications representing 12,975 units were also received during the period.

The newly introduced Innovation Unit approved 61 per cent of its 31 new build cases, doubling total approvals since February and reducing median approval time to 22 weeks.

London continues to be a key focus, accounting for 62 per cent of all Gateway 2 decisions, with 372 cases closed in the capital over the same period.

The regulator’s pilot batching process is significantly speeding up assessments, delivering initial supplier assessments in a median time of four weeks.

Remediation cases have also accelerated, with 92 decisions made at a 61 per cent approval rate, compared to 228 decisions for all of 2025.

A recently announced remediation improvement plan aimed at boosting resources, streamline processes, and provide guidance to applicants, with initial guidance is due in early April.

Chief executive officer Charlie Pugsley said the data reflects significant improvements from median decision times of 51.5 weeks in July 2025.

He said: “We continue to see improvements to numbers of approvals for new build and remediation cases and the time taken to get to a decision.

“By collaborating with specialised external engineering suppliers, we are significantly accelerating processing times, while maintaining our rigorous regulatory oversight.

“However, we recognise the need to push further on existing buildings. That is why our remediation improvement plan provides targeted measures to bolster our resources and support industry in submitting higher-quality applications.
